Canadian air passengers to be compensated up to $1,000 for flight delays or cancellation

Canada’s new air passenger rights come into effect on December 15.

Starting this Sunday, the Canadian Transportation Agency’s (CTA) latest Air Passenger Protection Regulations (APPR) will be rolled out, protecting travellers flying to, from, and within Canada.

The newest regulations will provide passengers with compensation of up to $1,000 for flight delays or cancellations for reasons within the airlines’ control (except for safety reasons); as well as amenities when there is a flight delay or cancellation within the airline’s control (reasonable food and drink; access to communication; and hotel accommodations for overnight delays).

According to the regulations, airlines will also have to take steps to seat children under the age of 14 near their accompanying adult, at no extra cost.

“Air travellers will now have full rights when things don’t go as expected. With input from air travellers and the air industry, we have created a world-leading approach to air passenger rights that is clear, consistent, transparent, and fair,” said Marc Garneau, Minister of Transport.

The first phase of the Air Passenger Protection Regulations, related to communication, tarmac delays, denied boarding, lost and damaged luggage, and transporting musical instruments, came into effect on July 15.

Airlines will now be required to follow these regulations or they could face penalties of up to $25,000 per infraction.

“Both air passengers and airlines deserve a consistent approach that allows passengers to be treated fairly while ensuring the industry remains strong and competitive,” said Garneau. “We believe these regulations achieve this important balance.”

To help passengers navigate their rights, the CTA has set up an online service for air passengers. The website allows passengers to learn about their rights, and file an air travel complaint.
