Canadian restaurant chain ordered to pay thousands in B.C. case

A notable Canadian restaurant chain has been named in a BC Civil Resolution Tribunal dispute over debt related to refrigeration services.

Freshii was named in the dispute, with thousands of dollars at stake. Freshii is an establishment you’ve likely come across or have visited, as it has quite a few locations around the province and across the country.

According to the BC Civil Resolution Tribunal dispute decision, PS Refrigeration (PSR) claimed Freshii owed it $3,501.24 relating to six unpaid invoices. While Freshii, doing business as Divitiae Foods, didn’t deny owing the money, it said that PSR damaged one of its fridges, and the fridge was worth more than PSR claimed Freshii owed.

Freshii requested that the tribunal dismiss the case. The tribunal didn’t dismiss the case, but Freshii didn’t have to pay as much as PSR claimed.

PSR provided six invoices to the tribunal. The invoices included labour, material, and travel costs. After analyzing the invoices, the tribunal found that the amounts listed were reasonable and ultimately deemed Freshii responsible for labour costs of $1,705.

Thanks to how clearly PSR laid out its material costs, the tribunal also determined Freshii was responsible for them, totalling $833.40.

After analyzing all the invoices, the tribunal deemed Freshii responsible for $2,665.32. However, as mentioned, Freshii sought a set-off, claiming PSR damaged one of its fridges and that the damage was worth more than $3,500.

Freshii claimed that an untrained PSR employee entered one of its locations and damaged a refrigerator. Unfortunately for Freshii, it didn’t provide any invoices, didn’t specify which location the fridge was damaged at, and didn’t provide any substantial evidence of its claims about the damaged fridge.

“So, I find the allegation PSR damaged one of Freshii’s refrigerators unproven. In any event, I find allegedly deficient refrigerator repairs are outside ordinary knowledge, and require expert evidence, which Freshii did not provide,” the tribunal said.

In total, including tribunal fees, Freshii was ordered to pay PSR $2,665.32 within 30 days of the tribunal decision.
