Thousands in B.C. could be entitled to $31-million HVAC class-action lawsuit

Thousands of B.C. residents could be entitled to a $31 million pot in a class-action lawsuit related to HVAC units, including air conditioners.
Information about the class action was shared by Consumer Protection BC (CPBC), and it may impact anyone who signed a lease for a heating, ventilation, or air conditioning system, also known as an HVAC system.
The class action impacts anyone who signed a lease for HVAC or HVAC equipment between July 17, 2023 and Jan. 15, 2025.
“While the vendor who leased the equipment did business under several names, including Simply Green Home Services, Crown Crest, Sandpiper Energy Solutions, or HCSI Home Comfort, anyone who leased HVAC equipment during the timeframe is encouraged to see if they qualify for a claim,” CPBC says.
“You may be entitled to money, lease cancellation benefits or both, from a class action settlement approved by the Ontario Superior Court of Justice.”
According to the lawsuit, it is alleged that the companies involved breached consumer protection laws “by collecting money from homeowners under lease agreements and registering a Notice of Security Interest, or NOSI, on a consumer’s home, among other things.”
“More than $30 million has been set aside for consumers, as well as other benefits, including a court order to remove the NOSI,” CPBC adds.
While CPBC is not directly involved in the suit, it says that in 2020, it “banned Simply Green Home Services from door-to-door sales in B.C. for one year after a rash of consumer complaints against the company. Consumer Protection BC found the company engaged in deceptive business practices, and Simply Green did not give customers the refunds they were entitled to under the law.”
