BC Supreme Court class action lawsuit filed against Volkswagen

A proposed class-action lawsuit has been filed in BC Supreme Court against Volkswagen, in the wake of revelations the software on its diesel-engine vehicles was designed to cheat emission tests.


It’s filed on behalf of West Vancouver-based Blitzkreig Motorcars, which leased a new Volkswagen Jetta diesel engine as a courtesy car for customers last year.

The suit alleges it contains a device which provides false and inaccurate emissions readings.

Burnaby lawyer Mark Canofari says modifications to bring the vehicle to environmental compliance would diminish its value.

“Right now these vehicles are not compliant with Canadian environmental standards. They are significantly not compliant. So what would happen is the vehicles would likely have to be detuned, which means a loss in performance, and very well a loss in fuel economy as well.”

The class action has not yet been certified. None of the allegations has been proven in court.


Former Volkswagen CEO Martin Winterkorn announced his resignation amid the scandal on September 23.

“As CEO I accept responsibility for the irregularities that have been found in diesel engines and have therefore requested the Supervisory Board to agree on terminating my function as CEO of the Volkswagen Group. I am doing this in the interests of the company even though I am not aware of any wrong doing on my part,” Winterkorn said in a statement.

Around 11 million vehicles have been affected globally by the emissions scandal, forcing the automaker to set aside billions of Euros to cover the cost of repair work to recalled vehicles.
