Canada's medicinal cannabis system will continue after recreational legalization

With the legalization of recreational cannabis in Canada exactly one month away as of today, Health Canada says that while the laws and processes around recreational cannabis use will change, the system currently in place for medicinal cannabis will not.

Currently, cannabis use for medicinal purposes is legal, as long the individual is authorized by a health professional to do so, and registered with a licensed producer or Health Canada.

In a statement, Health Canada said it remains committed “to maintaining a distinct system to provide patients with reasonable access to cannabis for medical purposes.”

It notes, that under the new Cannabis Act, individuals will still be able to purchase cannabis directly from a federally licensed producer, register to produce a limited amount of cannabis for their own medical purposes, and/or designate someone to produce it for them.

Health Canada is also reminding the public that while legalization is set to go ahead on October 17, the Cannabis Act establishes serious criminal penalties for those who sell or provide cannabis to youth. It also establishes new offences and strict penalties for those who use youth to commit a cannabis offence.

It also notes, that when it comes to growing your own at home, “provinces and territories have the flexibility to apply added restrictions on personal cultivation.”
